Seem Internet Solutions provides World Wide Web page hosting. Seem Internet Solutions reserves the right to suspend or cancel a customer's access to any or all services provided by Seem Internet Solutions when Seem Internet Solutions decides that the account has been inappropriately used or otherwise.

SERVER USE

Account holders are not permitted give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of important data. 

Seem Internet Solutions do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Seem Internet Solutions.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

You may not run server processes (eg. talkers/IRC Bots) from your account. Live Chat scripts and applications must not be installed , as these are often found to use excessive system resources. Storage and / or running of .exe and / or .dll files is not permitted.

Spamming or any type of UCE (Unsolicited commercial e-mail), is strictly prohibited, and your account may or will be closed immediately if you are found to be doing so.

BANDWIDTH / DATA TRANSFER

In rare cases of an account exceeding the bandwidth / data transfer allowance , Seem Internet Solutions reserve the right to disable your site until you can pay for the additional bandwidth / data transfer used . Seem Internet Solutions will also request a deposit in lieu of future bandwidth / data transfer use. In extreme cases or if no arrangement can be reached, Seem Internet Solutions reserves the right to terminate the account immediately. Additional data transfer will be sold at Seem Internet Solution's rate applicable at the time.

SERVER RESOURCES

Seem Internet Solutions may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. Resources can include but not limited to bandwidth and/or processor utilization and Seem Internet Solutions are the sole determinant of what constitutes degraded server performance. In such instances we reserve the right to disable your site until you can reduce your drain on server resources. In extreme cases or if no arrangement can be reached, Seem Internet Solutions reserves the right to terminate the account immediately and all files (including web pages, etc.) may be deleted.

PAYMENT

No bills or invoices will be sent by regular mail. All payment is in U.K. Sterling. Seem Internet Solutions reserves the right to change prices at any time.

In the event of a charge back by a credit card company or other payment provider authorized by Seem Internet Solutions, any related domain name registration shall be transferred to Seem Internet Solutions as the paying entity for the registration. Seem Internet Solutions may reinstate your domain name registration at its sole discretion upon its receipt of the registration or renewal fee and its then current reinstatement fee. If there are any outstanding fees owed by you , either for hosting , or domain registration , Seem Internet Solutions reserve the right to refuse transfer of a domain , until said fee(s) are settled.

CANCELLATION

Seem Internet Solutions reserves the right to cancel service at any time. All fees paid in advance of cancellation will be prorated and refunded by Seem Internet Solutions if Seem Internet Solutions institutes its right of cancellation. If cancellation is caused by customers breach of these terms and conditions, then no refund is due.

Customers can cancel service any time however no refunds will be made, due to set up costs. Excepted from the European Directive on distance selling (7 day cancellation period) which is incorporated into UK law by The Consumer Protection (Distance Selling) Regulations 2000. "There are exceptions where the 7-day cancellation period is not given, these include where the service had commenced with the consumers' agreement before the end of the cancellation period."

When an account is closed, all files (including web pages, etc.) will be deleted. 

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold Seem Internet Solutions harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Seem Internet Solutions, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Seem Internet Solutions against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Seem Internet Solutions' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Seem Internet Solutions' server.

DISCLAIMER

You understand that there are times when a service machine may crash or need to be upgraded. As such there may be times of service downtime and thus you will not be able to use the service. You will not be eligible for any compensation in such circumstances. We will use our reasonable endeavours to maintain your services at all times. We shall not be liable for any consequential losses you may suffer.

Seem Internet Solutions will not be responsible for any damages your business may suffer. Seem Internet Solutions makes no warranties of any kind, expressed or implied for services we provide. Seem Internet Solutions disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Seem Internet Solutions and its employees. Seem Internet Solutions reserves the right to revise its policies at any time.

These terms and conditions do not affect the consumers' statutory rights.
